1. About the Platform

Find My Creator is a creator relationship management platform that enables agencies and brands to recruit, brief, manage and approve UGC creators. The platform is operated at fmc.fmdigitalsolutions.co.za by FM Digital Solutions, a South African business.

The platform serves two types of users: agencies (and their team members) who manage creator campaigns, and creators who are invited to participate in those campaigns.

2. Accounts and Access

You must be at least 18 years old to register an account. By creating an account you confirm that the information you provide is accurate and that you will keep it up to date.

Agency accounts are invite-based during the current beta period. Creator accounts are created by invitation from a registered agency. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Agency administrators are responsible for managing their team members' access and removing access promptly when a team member leaves.

3. Subscription Plans and Billing

Find My Creator operates on a flat monthly subscription. Agency accounts are subject to the plan they select, which determines the number of creators and campaigns available. Plan details and pricing are published on the pricing page.

During the current beta period, billing has not yet been activated. Founding agencies are onboarded free of charge and will lock in their plan rate before billing goes live.

Subscription payments are processed by PayFast. We do not store payment card details. We do not charge commission on creator spend. We do not charge per-seat fees. Your subscription covers all features on your plan for your entire team.

4. Acceptable Use

You agree to use Find My Creator only for lawful purposes. You must not:

• Harass, threaten or discriminate against any creator or team member
• Upload content that is defamatory, unlawful or infringes third-party intellectual property rights
• Attempt to access another organisation's data or any part of the platform you are not authorised to use
• Provide false information about your organisation, brand or campaigns to creators
• Use automated tools to scrape or extract data from the platform
• Reverse engineer or attempt to extract the platform's source code

We reserve the right to suspend or terminate accounts that violate these terms.

5. Creator Relationships and Campaigns

Find My Creator facilitates the workflow between agencies and creators. We are not a party to any agreement between them. Agencies are solely responsible for the campaign terms they set, the rates they offer, the briefs they send and the approval decisions they make.

Agencies are responsible for ensuring their use of creator content complies with applicable laws, including advertising standards, intellectual property law and any agreed usage rights, territory and duration set in the campaign.

Any payment disputes are between the agency and the creator. FM Digital Solutions has no liability for payments or agreements made outside the platform.

6. Content and Intellectual Property

Creators retain ownership of the content they create. By submitting content through Find My Creator, creators grant the commissioning agency a licence as specified in the campaign's usage rights settings. That licence is between the creator and the agency, not FM Digital Solutions.

Find My Creator does not claim ownership over creator content or campaign materials. We store content submission links and data solely to facilitate the service.

7. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

8. Cancellation and Refunds

You may cancel your subscription at any time by contacting us at admin@fmdigitalsolutions.co.za. On cancellation your account will remain active until the end of your current billing period, after which access will be removed and no further charges will be made.

We do not offer pro-rata refunds for the unused portion of a billing period. If you cancel mid-month, you retain access until the end of that billing cycle. No partial month refunds are issued.

If you believe you have been charged in error, contact us within 14 days of the charge and we will investigate. Errors confirmed by FM Digital Solutions will be refunded in full within 10 business days.

During the current beta period, no billing is active. Beta accounts can be closed at any time with no financial implications.

On cancellation or account closure, your data will be retained for the period configured in your workspace settings and then permanently deleted. You may request an earlier deletion by contacting us directly.

9. Plan Changes and Downgrades

You may upgrade your plan at any time. Upgrades take effect immediately and the new rate applies from the next billing cycle.

You may request a downgrade by contacting us. Downgrades take effect at the end of your current billing period. If your current usage exceeds the limits of the plan you are downgrading to (for example, you have more creators than the lower plan allows), you will need to reduce your roster to the new plan limit before the downgrade takes effect.

We reserve the right to modify plan limits and pricing with 30 days' notice. Existing subscribers who are negatively impacted by a price increase may cancel within that notice period without penalty.

10. Platform Availability

We aim to keep Find My Creator available at all times but cannot guarantee uninterrupted access. We may carry out maintenance or updates that temporarily affect availability and will provide advance notice where possible.

During the beta period, the platform is provided as-is. Features may change as the product develops.

9. Account Termination

You may close your account at any time by contacting admin@fmdigitalsolutions.co.za. Your data will be retained for the period configured in your workspace settings then permanently deleted in line with our Privacy Policy.

We may suspend or terminate your account if you breach these terms, if a subscription payment fails after a grace period, or if continued access poses a legal or security risk to FM Digital Solutions or other users.

10. Limitation of Liability

To the maximum extent permitted by South African law, FM Digital Solutions shall not be liable for any indirect, incidental or consequential damages arising from your use of the platform, including loss of revenue, loss of data or loss of business opportunity.

Our total liability for any claim shall not exceed the total subscription fees paid by you in the three months preceding the claim.

11. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-platform notification. Continued use of the platform after changes are published constitutes acceptance.
